The County of Marin is updating our Local Coastal Program and we're hoping to find out how Farmworker Housing is treated in the Coastal Zone of other jurisdictions. I've provided what I believe is an outline of state law below. Does the law provide exceptions for agricultural lands in the Coastal Zone?
For the purposes of zoning and land use, Section 17021.5 of the Health and Safety Code considers farmworker housing for five, but no more than six farmworkers as a single-family structure and as a residential land use. “No conditional use permit, zoning variance, or other zoning clearance shall be required of employee housing that serves six or fewer employees that is not required of a family dwelling of the same type in the same zone.” (Health & Safety Code § 17021.5).
In addition, Section 17021.6 considers farmworker housing consisting of no more than 36 beds in group living quarters or 12 units or spaces for farmworkers and their households as an agricultural land use. “No conditional use permit, zoning variance, or other zoning clearance shall be required of this employee housing that is not required of any other agricultural activity in the same zone. The permitted occupancy in employee housing in an agricultural zone shall include agricultural employees who do not work on the property where the employee housing is located.” (Health and Safety Code § 17021.6).
